Boat Rental Terms

By hiring The Midnight Molly you will be subject to the following terms and conditions.

General Conditions

Revelation Sky Pty Ltd is the owner of the vessel. Revelation Snuggle Pty Ltd is the operator of the vessel.

The hirer acknowledges and accepts the that the use and operation of the vessel, is subject to inherent risks and dangers. The Hirer accepts those risks and agrees to indemnify the Owner of the vessel, Revelation Sky Pty Ltd for any losses suffered by the Hirer, any passengers or any third parties as a result of the materialisation of those risks and dangers. The Hirer also undertakes to advise all passengers of the risks and dangers associated with the use and operation of the vessel prior to boarding. The hirer acknowledges and understands all safety material and briefings that have been presented.

All hirers release Revelation Sky Pty Ltd for any claim whatsoever and howsoever incurred including but not limited to a claim for death, bodily injury, damage or loss of property during embarkation and/or disembarkation to or from the vessel and/or at all times whilst onboard the vessel itself, except to the extent death, bodily injury, damage or loss of property has been caused or contributed to by the negligence of the operator.

We reserve the right to refuse the hirer if we believe you to be intoxicated or under the influence of substances. If the hire is cancelled for any reason by us, including unfavourable weather conditions or mechanical issues then we will reschedule your booking for a future time if availability allows or offer you a full refund.

Night-time hire may only be offered to holders of a valid Recreational Skippers Ticket. All other hire must only be conducted between the hours of sunrise and sunset.

Pricing Policy

All prices are in Australian Dollars (AUD) and include GST. We reserve the right to alter the prices at any time. Eftpos transactions will incur a 1.9% transaction fee.

Payment and Cancellation Policy

Payment must be made before departure.

All cancellation requests must be in writing to bookings@seadreamstudios.com.au. Calling, leaving a message or speaking to the team in person is not an acceptable form of cancellation.

Cancellations or postponed bookings will only be accepted 72 hours prior to hire date. Cancellations or postponed bookings within 72 hours of the booking date will incur a charge for the full hire fee.

If you arrive after the hire time has commenced, the hire time will be shortened, and you are expected to still return at the end of the original hire time.

If poor weather conditions are present before the hire proceeds a transfer in reservation will be granted, however we do not grant such a transfer for rain alone.

There are no refunds or credits available for change of mind and prematurely ending the hire or if you arrive late on the day.

Cancellation due to your inability to travel or for health issues will be subject to manual review. We will consider a refund at our discretion.

Missing or Not Returning Your Hire

You are expected to arrive 15 minutes prior to your scheduled hire time. If you arrive after this time, we reserve the right to shorten your hire time. We will not offer refunds if you do not show up for your hire or offer rescheduling.

Should the hired vessel not be returned within the time stipulated then a charge equivalent to a single day hire, or part thereof shall be charged until the vessel is returned. If the hirer is unable to be made contact with, it will be deemed the hirer to have lost / stolen the vessel and Revelationsky Pty Ltd will take steps to regain possession, including police action.

Passenger Limits

The Midnight Molly has a maximum passenger limit of 8 persons. This including all children. This is a legal passenger limit and must be adhered to at all times. If you miscalculate the number of passengers we will not offer a refund or reschedule at the last minute, you will only be able to board the maximum number of passengers.

If your hire includes a tour guide then they will be using one seat, this means if you book The Midnight Molly with a tour guide, the maximum number of passengers allowed is 7.

During Your Hire

You agree that:

(a) You and passengers under your care agree to never put your arms or legs over the railings or through the gaps in the side of the vessel or sit on the railings or gates.

(b) You will not exceed the speed limit as posted in the Peel Inlet and you are responsible for reading these signs. If in doubt, 5 knots is always a safe speed.

(c) You will only operate the vessel between sunrise and sunset, unless you are the holder of a valid Recreational Skippers ticket.

(d) Will only operate the vessel in the Peel Inlet or Murray River (protected waters). Exiting into the ocean will immediately void all insurance and you will be personally liable for all costs, damages, legal fees or any other expense or criminal offense arising from this activity.

(e) Will only allow the vessel to controlled at all times by the listed driver.

(f) You will not drive the vessel whilst under the influence of liquor or drugs, or with a blood alcohol content in excess of any statutory limit. Permissible concentration of alcohol for drivers of recreational vessels is less than 0.05. Random breath testing can be conducted on drivers, and penalties range from $1100 for a first offence in the low range to $5,500 and up to 2 years imprisonment.

(g) You will NOT allow any other person to control the vessel unless listed on the booking form and is responsible for all occupants and their actions.

(h) Report any accident to the nearest police station and the owner forthwith.

(i) Not have the vessel repaired except with the express permission and consent of the owner and the owner shall be at liberty to direct any particular person to make such repairs or to do such repairs provided that the owner shall not incur any liability in respect of such repairing.

(k) WIll not tow an object or person behind the vessel.

In the event of the vessel breaking down or the onset of poor weather conditions, the hirer shall notify the operator to arrange the immediate return of the vessel. The period of the hire shall be determined upon the return of the vessel. In no event shall the owner be responsible for any costs / loss incurred by the hirer.

If we have to come to your aid due to running aground, getting stuck or crashing into another vessel, you will be charged a fee based on how far you are from the Port Bouvard Marina. A minimum charge of $50 applies.

Cleaning

If you make an unreasonable mess on the vessel we reserve the right to charge you a minimum of a $150 cleaning fee.

Damage

Accidental damage insurance only covers the loss and damage to the vessel during the period of hire and does not cover the loss or damage of:

i) Personal items.

ii) Due to negligence or criminal action by the hirer.

iii) Resulting from overloading, speeding, overheating, seizure or misuse of the vessel.

iv) When the vessel is overdue for return.

v) Arising from more than one accident or event.

vi) If at any time the driver of the vessel is not the authorised person under this hire contract.

Accident damage does not cover the first $2,000 of damage, which will be the hirer’s responsibility. A security bond will be required prior to departure. The bond will be refunded so long as no damage occurred to the boat during the hire period. Where damages occur charges of up to $2000 may be debited from the credit card provided, where damages are covered by insurance.

You agree to pay the owner the cost of repair; replacement of any loss or damage howsoever caused which is not covered by insurance due to any breach by the hirer or any other cause whatsoever.

The owner shall not be responsible for any fines incurred or any breaches of marine regulations in respect to the vessel whilst under control or custody of the hirer or during the continuance of the term of the hire.

Additional Costs

You are liable for all damage to our vessels and 3rd party vessels. Here is a list of potential costs you may be liable for:

* Loss of anchor and chain: $100

* Recovery fee if you run aground $25 per km from the Port Bouvard Marina, minimum charge of $50.

* Damaged propeller caused by running aground or hitting rocks: $150

* Damaged gearbox caused by running around or hitting rocks: $1,500

* Damaged cannopy from climbing on the roof or collision: $250-$1000

* Torn / damaged canopy cover: $500 - $1000
